	A hearing was held and the record closed on December 16, 1991,
in Portland, Oregon, before the undersigned Referee.  The
plaintiff, Oregon OSHA, appeared by its attorney Kevin Shuba. 
The defendant, Portland General Electric Company, appeared by
its attorney, Ann Fisher.  The court recorder was Jan Nelson.



                             ISSUE



	The only issue is whether Item number 1-1 of Citation number
T201700891 is appropriate.



                     STIPULATION OF FACTS



	The defendant's premises at 4245 Kale Street NE, Salem, Oregon
is a limited access building under the exclusive control of the
defendant, which contains vehicles for fabrication and repairs,
air compressor, welding equipment, metal shop equipment, vehicle
servicing and repair equipment, vehicle hoist and pits, and
miscellaneous electrical installation and repair equipment.  The
premises are used to store electrical equipment and to fabricate
metal for use in electrical distribution systems.



	The defendant's premises are exempt from the lock-out/tag-out
provisions.



                  CONCLUSIONS OF LAW AND OPINION



	The defendant moves to dismiss Item 1-1 from the citation.  OAR
437-02-140 provides that installations under the exclusive
control of electric utilities for the purpose of power
generation, transmission and distribution, including any related
equipment for communication or metering is exempt from the
safety standards.  PGE is an electric utility regulated by the
Oregon Public Utility Commission.  PGE premises, which were the
subject of the citation herein, is a limited access building
under the exclusive control of PGE and containing various pieces
of equipment and material for fabricating and maintaining
electrical distribution systems.  For these premises at 4245
Kale St NE, Salem, Oregon, I conclude that the defendant is
exempt from the standards.   Accordingly, the defendant's motion
to dismiss item 1-1 from the citation should be approved.



                             ORDER



	IT IS HEREBY ORDERED that Item 1-1 of Citation T201700891 is
deleted and the balance is affirmed.



	NOTICE TO ALL PARTIES:  You are entitled to judicial review of
this Order.  Proceedings for review are to be instituted by
filing a petition in the State Court Administrator, Record
Section. 1163 State St, Salem, OR 97310, within 60 days
following the date this Order is entered and served as shown
hereon.  The procedure for such judicial review is prescribed by
ORS 183.480 and ORS 183.482.
